Giovanna Montanaro publishes article on the revision of the Insurance Contract Act

Our partner Giovanna Montanaro has published an article in the latest issue (6/2025) of Internationales Handelsrecht (IHR) on the application of the revised provisions of the Insurance Contract Act to existing contracts. In it, she analyzes the case law of the Federal Supreme Court, in particular FSC 151 III 35, in which the Federal Supreme Court clearly rejects the retroactive effect of the general direct right of claim on the basis of a thorough interpretation of the law.
