Andrea Meier presents the ASA Arbitration Toolbox at the UNCITRAL Congress in celebration of UNCITRAL's 50th anniversary

In July 2017, UNCITRAL hosted a three day Congress to celebrate UNCITRAL's 50th anniversary and explore new directions in cross-border commerce. Leaders in the field of international trade law, including practitioners, judges, academics, international officials and other experts considered ways in which UNCITRAL's texts on international trade law can contribute to innovation and sustainable development in the coming years. Andrea Meier presented the ASA Arbitration Toolbox, an interactive electronic handbook designed to assist practitioners in organizing arbitral proceedings.

At the ASA Conference of 3 February 2017 in Geneva on "Shaping Arbitral Proceedings to Best Examine Quantum", Andrea Meier moderated a panel regarding the examination of quantum in cases where quantum depends on information possessed only by the respondent. With her panel, consisting of David Roney, Bernd Ehle and John Biggart, she discussed typical difficulties arising in this scenario, with lively contribution from the audience.

New article by Andrea Meier and Anna Lea Setz on Arbitration Clauses in Third Party Beneficiary Contracts published in ASA Bulletin, Volume 34, No. 1, 2016

In a third party beneficiary contract, two parties stipulate that performance is to be rendered to a third party. If a third party beneficiary contract contains an arbitration clause, a number of questions arise, e.g. who has the right to invoke the arbitration clause and who is under an obligation to do so. The article discusses the pertinent issues on the basis of different scenarios.

Besonders beleuchtet wird die konkrete Berechnung der Entschädigung bei Festhypotheken, namentlich die Frage nach dem angemessenen Wiederanlagesatz und die Auswirkungen der aktuell zu beobachtenden Negativzinsen.

Plädoyer zitiert Peter Reichart zum Thema "Akten studieren genügt nicht" betreffend die private Zeugenbefragung durch den Anwalt. Gemäss Peter Reichart gehört die private Zeugenbefragung im Zivilprozess zu den Grundsätzen der freien Anwaltsausübung. "Es genügt nicht, Akten zu studieren und sich vom Mandanten instruieren zu lassen. Vielmehr müssen regelmässig potenzielle Zeugen befragt werden. Eine sorgfältige Prozessführung verlangt, dass der Anwalt die verfügbaren Informationsquellen ausschöpft." Unterstützung erhält Peter Reichart vom Zivilprozessrechtsspezialisten Peter Hafter und Lorenz Droese, Assistenzprofessor für Zivilverfahrensrecht an der Universität Luzern.

Panel discussion with Andrea Meier on emergency relief featured in GAR

A panel co-organised by the Zurich Bar Association’s arbitration and litigation practice groups compared emergency arbitration and interim measures granted by state courts. In light of the concurrent jurisdiction between arbitral tribunals and state courts to issue interim measures, the choice between these two options is of high practical relevance in Swiss arbitration practice. Panelists included Justice Peter Helm, president of the Commercial Court of the Canton of Zurich, and Andrea Meier, Partner of Wartmann & Merker. The event was reported in GAR.

Andrea Meier appointed co-chair of ASA Below 40

In October 2012, the Swiss Arbitration Association (ASA) appointed Andrea Meier as co-chair of ASA below 40, with effect from November 2012. ASA below 40 is the young practitioners' group of ASA and one of the longest-standing 'below 40' groups in the international arbitration community. ASA below 40 has more than 1,400 members from Switzerland and abroad. The group aims at facilitating contact and the exchange of views and experiences among young Swiss and foreign arbitration practitioners in a friendly and informal way. The group currently hosts three international arbitration events per year, and sometimes additional events jointly with other young practitioners’ organizations.

Meier’s election was reported in Global Arbitration Review Briefing on 11 October 2012.
